ARTICLE 1: SCOPE AND APPLICATION

These General Terms and Conditions of Sale (hereinafter "Terms") apply to all purchases made by individual consumers (hereinafter the "Customer") on the website www.histohead.com (hereinafter the "Site"), owned and operated by HistoHead (hereinafter the "Seller").

By placing an order on the Site, the Customer acknowledges having read, understood, and accepted these Terms without reservation. We ship internationally to select regions in Europe, North America, and Asia Pacific.

ARTICLE 3: PRODUCTS AND FULFILLMENT

The Site offers apparel, home goods, and other print-on-demand items. The Seller utilizes a print-on-demand business model. Every item is made to order upon purchase and fulfilled via our production partners.

While we take great care in describing our products accurately, the Seller cannot be held liable for minor variations in color or design representation on the Customer's screen.

ARTICLE 4: PRICING AND CURRENCIES

Prices are displayed in the Customer's regional currency based on their location.

  • For customers within the European Union, prices are inclusive of applicable VAT.
  • Prices do not include shipping and handling costs, which are calculated and displayed prior to final order validation.
  • The Seller reserves the right to modify prices at any time, but products will be billed based on the rates in effect at the exact moment the order is validated.

ARTICLE 5: CUSTOMS AND IMPORT DUTIES

To provide the fastest service and minimize extra costs, the Seller utilizes a global network of printing facilities, including locations in the European Union (Spain, Latvia), the United Kingdom, the United States, Canada, Australia, and Japan.

  • Local Fulfillment: Whenever possible, orders are printed and shipped from the facility closest to the Customer. For customers in the EU, UK, and US (and for certain product variants in Canada, Australia, and Japan), this typically means orders are shipped domestically or intra-EU, and no customs or import duties will apply.
  • International Routing: Occasionally, depending on the specific product variant chosen or stock availability, an order may need to be fulfilled from a facility outside the Customer's local region.
  • Duties and Taxes: In the event an order crosses international borders, the Customer is considered the importer of record. These shipments may be subject to customs duties, import taxes, and local processing fees levied by the destination country. The Seller has no control over these charges, cannot predict their amount, and these fees remain the sole responsibility of the Customer.

ARTICLE 6: THE ORDERING PROCESS

The contract is formed through the following steps:

  1. Cart: The Customer selects the desired items and adds them to the cart.
  2. Checkout: The Customer reviews the cart, selects a shipping method, and provides delivery and billing details.
  3. Confirmation: The Customer checks the order summary, accepts these Terms, and clicks to confirm payment.
  4. Payment: The Customer completes the payment.
  5. Acknowledgment: The Seller sends an email confirming the receipt of the order.

ARTICLE 7: PAYMENT TERMS

Payment is due immediately upon ordering. We accept Visa, MasterCard, PayPal, Apple Pay, Shop Pay. Transactions are secured by Shopify Payments.

ARTICLE 8: DELIVERY

Because products are made to order, delivery times include both fulfillment (printing) and transit times. Orders are routed to the production facility closest to the Customer's location whenever possible. Delivery times, costs, and specific regions served are detailed in our Shipping Policy. The risk of loss or damage to the goods passes to the Customer at the moment they (or a designated third party) take physical possession of the products.

ARTICLE 9: RIGHT OF WITHDRAWAL, RETURNS, AND REFUNDS

9.1 THE LEGAL RIGHT OF WITHDRAWAL & OUR 30-DAY POLICY

In accordance with Article L221-18 of the French Consumer Code, the Customer has a legal right of withdrawal of fourteen (14) days. As a commitment to our customers, the Seller extends this period. The Customer has thirty (30) days from the date of delivery to request a return for any standard item without having to justify their reasons or pay any penalty fees, other than the return shipping costs.

9.2 EXEMPTIONS (PERSONALIZED GOODS)

The right of return does not apply to any products that have been explicitly personalized or customized at the Customer's request (e.g., adding a custom name or bespoke design modification).

9.3 RETURN SHIPPING COSTS

We do not offer free returns. The Customer is solely responsible for paying all return shipping fees. Return shipping labels are not included in the original packaging.

9.4 RETURN PROCEDURE

Because our items are printed on demand and fulfilled via a global network of printing facilities, returns must be routed accurately. To initiate a return, the Customer must follow these steps:

  1. Contact Us First: The Customer must contact our customer service at support@histohead.com within 30 days of delivery to notify us of the return.
  2. Return Destination: Items must be shipped back to the specific printing facility that originally produced and dispatched the order. The correct return address is located on the packing slip included with the delivery.
  3. Condition of Items: Returned items must be unworn, unwashed, and in their original condition.

9.5 REFUNDS

Once the returned item is received and inspected at the designated facility, the Seller will process the refund to the Customer's original method of payment within fourteen (14) days. The refund will include the price of the purchased items and standard outbound delivery costs, but excludes any return shipping costs paid by the Customer.

ARTICLE 10: LEGAL WARRANTIES

The Seller guarantees that the products comply with the contract and are free from hidden defects. The Customer benefits from two legal warranties under French law:

  • The Legal Warranty of Conformity: The Customer has a period of two (2) years from the delivery of the product to act, requesting repair or replacement.
  • The Warranty Against Hidden Defects: In the event of a hidden defect rendering the product unfit for use, the Customer has two (2) years from discovery to act for a full or partial refund.

ARTICLE 11: INTELLECTUAL PROPERTY

All graphics, designs, images, and text displayed on the Site are the exclusive intellectual property of the Seller or its partners. Any reproduction, exploitation, or use without explicit permission is strictly prohibited. For general website usage rules, see our Terms of Service.

ARTICLE 13: CONSUMER MEDIATION

In the event of a dispute, the Customer must first contact our customer service at support@histohead.com to seek an amicable solution.

If no satisfactory solution is found, in accordance with Article L612-1 of the French Consumer Code, the Customer has the right to use a consumer mediation service free of charge. The Seller is affiliated with the following mediation service:

ARTICLE 14: APPLICABLE LAW AND JURISDICTION

These Terms are governed by French law. However, for international consumers, this choice of law does not deprive the Customer of the mandatory consumer protection rights granted by the laws of their country of residence. In the event of an unresolved dispute, the courts of the Customer's place of residence or the French courts shall have jurisdiction.
